    EU Biocidal Products Fee Standards Increase with Inflation Pressure Driving a 19.5% Rise

    On July 28, 2025, following the draft proposal to increase REACH registration fees, the European Commission passed Implementing Regulation No. 2025/1490, announcing an immediate increase in all official fees related to the approval of biocidal products. This adjustment reflects the cumulative inflation level of 19.5% between 2021 and 2023. Unlike the REACH draft, whose implementation date is yet to be determined, the new regulations for biocides will officially take effect on August 14, 2025, and will be directly applicable in all member states.

    Background

    In 2012, the EU issued the Biocidal Products REGULATION (EU) No 528/2012, requiring all active substances and biocidal products containing active substances to be approved or authorized before being marketed in the EU.

    In 2013, the accompanying Implementing Regulation (EU) No 564/2013 set detailed fee standards and introduced an annual inflation adjustment clause. This revision is the third systematic adjustment of this clause since its implementation in 2013.

    Main Adjustments

    1. Active Substance Approval
      • Initial approval fee increased from €120,000 to €143,400.
      • An additional €47,800 is charged for each new product type (previously €40,000).
    2. Renewal of Active Substance Approval
      • Renewal fee for the first product category increased from €15,000 to €17,925.
      • An additional €29,875 is charged for a comprehensive re-evaluation (previously €25,000).
    3. EU Authorization (Single Product)
      • New product authorization fee different from the representative product increased to €95,600 (previously €80,000).
      • "Same product" authorization fee for products identical to the representative product increased to €47,800 (previously €40,000).
    4. EU Authorization (Product Family)
      • The entire product family authorization fee increased to €179,250 (previously €150,000).
    5. Annual Fees
      • Annual maintenance fee for a single product increased to €11,950 (previously €10,000).
      • Annual maintenance fee for a product family increased to €23,900 (previously €20,000).
    6. Other Items
      • Major change application fee: €47,800 (previously €40,000).
      • Minor change application fee: €17,925 (previously €15,000).
      • Administrative change notification fee: €2,390 (previously €2,000).
      • Technical equivalence determination fee: depending on complexity, €5,975 / €23,900 / €47,800.
      • Appeal fee: €2,988 (previously €2,500).

    Micro, small, and medium-sized enterprises (SMEs) will continue to enjoy tiered fee reductions, with the reduction percentage based on the new standard fees, and eligibility criteria remain unchanged.
