    Three New Substances to be Added to SVHC Candidate List

    On June 16, 2025, the European Chemicals Agency (ECHA) announced that during the meeting held in June 2025, the Member State Committee (MSC) unanimously passed a resolution to classify two chemical substances as Substances of Very High Concern (SVHCs) and plans to include them in the Candidate List within this month. Additionally, a third substance will be directly added to the list without committee review.

    Responsibilities of Enterprises When Products Contain SVHCs

    1. Provide a Safety Data Sheet (SDS) to downstream users when SVHCs are sold individually.

    2. If SVHCs are components in a mixture and the concentration is &ge;0.1%, an SDS must be provided.

    3. If SVHCs constitute >0.1% by weight in an article, detailed information must be provided to downstream users or consumers within 45 days for free.

    4. If a single SVHC constitutes >0.1% by weight in an article and the annual export volume exceeds 1 ton, the manufacturer or importer must notify ECHA within six months.

    5. From January 5, 2021, products containing >0.1% SVHC must be reported under the SCIP directive, in accordance with the EU Waste Framework Directive (WFD).

    Other Outcomes of the Meeting

    • Two chemical compliance review resolutions were passed: Isooctyl acrylate EC NO. 249-707-8 and 2-ethylhexyl methacrylate EC NO. 211-708-6.

    • A testing proposal submitted by a member state for 2,3-epoxypropyl trimethoxysilane EC NO. 219-784-2 has been revised and approved.

    • MSC has completed the draft opinion for substances proposed for authorization and plans to initiate a written voting process after the summer to formally pass it.

    SVHC substances typically include Carcinogenic, Mutagenic, or toxic to Reproduction (CMR) category 1A/1B substances, Persistent, Bioaccumulative, and Toxic (PBT) substances, (very) Persistent, (very) Bioaccumulative and/or Toxic chemicals (vPvB) substances, and substances with clear evidence of similar hazards (such as endocrine disruptors). These substances are often considered potential candidates for the EU REACH Regulation Authorization List. Once a substance is added to the SVHC list, the likelihood of it being included in the Authorization List significantly increases.
