    Denmark to Ban PFAS-Containing Apparel, Footwear, and Waterproofing Agents from 2026

    On May 2, 2025, Denmark's Ministry of Environment issued new regulations prohibiting the import and sale of consumer products containing PFAS (per- and polyfluoroalkyl substances) in clothing, footwear, and certain waterproofing agents. While the regulations took effect on July 1, 2025, core restrictions will be enforced starting July 1, 2026, with businesses permitted to sell existing inventory until January 1, 2027.

    Key Highlights of the Ban

    1. Definition of PFAS

    PFAS refers to compounds containing at least one perfluoromethyl (CF3) or perfluoromethylene (CF2) carbon atom, excluding those with hydrogen, chlorine, bromine, or iodine atoms.

    2. Scope of Restrictions

    • Apparel and Footwear: All privately used products with any component exceeding 50 mg/kg of fluorine (measured as F).
    • Waterproofing Agents: Textile or footwear waterproofing agents for private use with fluorine content ≥50 mg/kg.

    3. Exemptions

    • Secondhand or refurbished apparel/footwear (recycled or repaired for reuse).
    • Personal Protective Equipment (PPE): Items compliant with EU Regulation (EU) 2016/425, Category III(a) (chemical/biological hazard protection) or III(c) (high-temperature/flame protection).
    • PPE where PFAS is essential for safety functions (e.g., critical to protective performance).
    • Waterproofing agents specifically for refurbishing Categories 3–4 PPE.
    • Medical devices.
    • Transit goods (not marketed in Denmark).

    4. Penalties

    Violators face fines, and intentional or grossly negligent actions causing health/environmental harm may result in up to two years’ imprisonment. Businesses may apply for case-specific exemptions by March 31, 2026, for technical or safety reasons, but decisions are final and non-appealable, with justification publicly disclosed.
