    Singapore's NEA Proposes Adding 26 Chemicals to List of Hazardous Chemicals Requiring an HS License/Permit

    From June 13 to July 4, 2022, Singapore's National Environment Agency (NEA) published a public consultation on the proposal to control 26 chemicals as hazardous chemicals because some of the 26 chemicals are highly toxic, polluting, and/or generate intractable waste that is difficult to manage and safely dispose of. During the consultation period, 52 feedbacks were received and suggestions on regulatory details were also collected. Below we have prepared a summary of the HS license/permit application and requirements. 

    The 26 chemicals are all listed in the Chemical Weapons Convention (CWC). Companies must consult relevant departments on the control of these substances.

    The NEA intends to publish these regulatory changes by December 2022. These changes will be followed by a six-month transitional period before coming into effect by June 2023. If the Proposed Control is successfully adopted, enterprises must make amendments to their existing HS license/permit or apply for an HS license/permit from January 1, 2023. Moreover, enterprises must obtain a valid HS license/permit to perform specified activities by June 2023.

    Companies performing activities involving any of these 26 chemicals shall obtain HS license/permit regardless of quantity. If companies have any questions about the exemption purity of these substances, they can provide relevant information to NEA by November 10.

    As to the HS license/permit, enterprises shall make applications based on their activities.

    Any person who imports, exports, manufactures, sells, transport, stores, and/or uses the regulated chemicals under the EPMA

    Any person who purchases, stores, and/or uses any hazardous chemicals under the EPMA

    As to the exemption situations, NEA gives a brief introduction. If these 26 chemicals are present in products or mixtures at low concentrations or as impurities, they are exempted from the proposed regulatory control. Moreover, companies shall submit supporting documents such as SDS and analytical reports to NEA for verification.

    There are also another nine chemicals that NEA is currently co-regulating with the Singapore Customs, which are:

    • Amiton,
    • Arsenic trichloride,
    • Phosgene,
    • Cyanogen chloride,
    • Hydrogen Cyanide,
    • Chloropicrin,
    • Phosphorus oxychloride,
    • Phosphorus trichloride, and
    • Phosphorus pentachloride.
