On December 29 2015, the General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China (AQSIQ) issued the Risk Warning Notice of Imported Food Safety, importers, overseas manufacturers, and overseas exporters with adverse import records were all listed in the negative list. Before the risk relieved, these enterprises will always be put up on the website of AQSIQ, and public can refer to these lists at any time.

1. Who are on the negative list?

1.1 The negative list of importers
A total of 67 importers were noticed, and the main unqualified food categories were dairy products, beverages, biscuits, aquatic products, chocolate, ice creams, nut products, etc.

CIRS Analysis

2. What are the main reasons for risk warning?

The main reasons for the risk warning of importers, overseas manufacturers, and overseas exporters were almost the same. “Unqualified microorganism, physical and chemical index”, “unapproved food additives or beyond the range”, and “uncompliant label” were the top 3 reasons for the risk warning. Among them, the microorganism, physical and chemical index was over 70%, which accounted for a large proportion of the total reasons.

3. If an enterprise is in the list, what are the negative impacts on it?

I. Once in the list, AQSIQ will take strict measures to supervise the enterprise. When importing relevant products again, the enterprise must provide testing reports or qualification certificates.

II. The controlling time should be at least 6 months, in serious cases, it will be more than 12 months, the imported batches of each category should be at least 5 batches, and during this period, there is no quality and safety issues occurred, then the enterprise can apply for the risk remove.

III. This negative list is put up on the website of AQSIQ for public supervision all the time. If an enterprise is in the list, it will be seriously abusing the trust of consumers.

4. How to avoid the appearance of adverse records effectively?

Top 1	Unqualified microorganisms, physical and chemical index, characters, etc.	GB tests and nutrient tests before importing in China The pre-tests in the qualified third-party labs in China can effectively help enterprises to realize whether the product meets the index requirements of Chinese regulations and standards or not. Although the tests also can be conducted overseas, it is more likely that the testing methods are different with the methods in China, which will lead to deviations. It will not spend too much money and time in conducting these tests in China, and according to the reasons for risk ranking, unqualified microorganism, physical and chemical index was the biggest problem, so CIRS strongly recommends imported enterprises to send their products to qualified third-party Chinese labs for pre-tests.
Top 2	Illegal food additives	Product compliance analysis before importing Imported food should be in compliant with the national standards for food safety in China. Imported enterprises are suggested to conduct the product analysis before importing, then based on the product national standard, GB 2760-2014, GB 14880-2012 and relevant NHFPC notices, the formula analysis should be conducted. It can greatly help to avoid the problems like “add unapproved food additives”, “non-edible materials”, “add food additives over range’, etc.
Top 3	Uncompliant label	Design a compliance Chinese label The Food Safety Law of China stipulated that imported prepackaged food, food additives should have Chinese label. The Chinese label should be in compliant with the national standards including GB 7718-2011, GB 28050-2011, GB 13432-2013, and relevant laws and regulations, otherwise, the import will also be forbidden.
Top 4	Certification problems	Prepare relevant qualifications and certificates before importing Certificate of origin, sanitary certificate for some special food, and other required certificates all should be prepared. The contents of certificates should meet the goods, otherwise, CIQ will also classify them as unqualified products.
